The enforcement picture

PRIORITY.
There is no federal standard requiring employers to provide hydration on a job site. What exists is an enforcement program — and it has grown sharply.
OSHA's National Emphasis Program on outdoor and indoor heat-related hazards was updated and reissued in April 2026 and runs for five years. It directs inspection resources toward 55 high-risk industries, with 22 industries added to the target list in the latest revision — including construction, manufacturing, transportation, warehousing, and agriculture.
Heat-related inspections have climbed from roughly 200 a year to about 2,400. Heat now accounts for around 6% of all federal OSHA inspections, up from well under 1%.
Employers cited for heat hazards are cited under the General Duty Clause, which requires a workplace free from recognized hazards likely to cause serious harm. There's no checklist — which means what you did to protect people is judged after the fact.

- A written heat injury and illness prevention plan, specific to each site
- An initial trigger at an 80°F heat index — access to drinking water, break areas, and acclimatization for new or returning workers
- A high-heat trigger at a 90°F heat index — paid 15-minute rest breaks every two hours and observation for signs of heat illness
- A designated heat safety coordinator
- Training for workers and supervisors on recognizing and responding to heat illness
OSHA published this proposed rule in August 2024. The public hearing concluded in July 2025 and the post-hearing comment period closed in October 2025. It has not been finalized and there is no announced target date. Several states enforce their own heat rules independently of federal action. How crews use it
TWO FORMULAS.
ONE STICKS TO WATER.
Caffeine-free, so it can go in the cooler without restriction. One stick per 8–10 oz. Use it at any point in the shift, including the end of one.
Same electrolyte base plus 350mg caffeine. One stick per day maximum, not for anyone under 18 or sensitive to caffeine. Best treated as an individual choice, not a cooler stock item.
